London Borough of Islington v Brown - Trade union rep's failure to present member's unfair dismissal claim in time is not adequate reason for an extension of time  EAT
Ms Brown claimed unfair dismissal - but her claim was presented to the employment tribunal 18 months after the three months time limit had expired.
Ms Brown relied on her lengthy and serious depression as the reason, coupled with the fact that her trade union representative was, at her instruction, dealing with the matter. The failure to present the claim was indeed an oversight by the trade union representative. An employment judge allowed her claim in out of time. Islington appealed.
