Where a prosecuting authority is also the employer of the person it prosecutes, complaints of discrimination solely in connection with its prosecution decisions - even where those decisions have a knock on impact on the employment relationship (such as disciplinary proceedings) - do not fall within the jurisdiction of the employment tribunal.
