London Utd Busways Ltd v Salim - Employment tribunal's conclusions not supported by evidence [2008] EAT
An employment tribunal concluded, by majority, that Mr Salim was unfairly dismissed. His dismissal had been because, as a bus driver, he had failed breath tests. In that respect the tribunal found he contributed 100% to his dismissal. However the tribunal majority concluded that he did not have reasonable time to consider the allegations against him, a breach of the statutory procedures that made his dismissal automatically unfair. Busways appealed.
