LTRS Estates Ltd (t/a Orwells) v Hamilton - EJ's decision failed to set out facts to support conclusion
Justice requires that an Employment Judge's judgment must, at the very least, set out the facts in sufficient detail as to form the basis for the legal analysis that leads to the decision.
An Employment Judge (EJ) found in favour of restaurant manager Mr Hamilton in his claims for unlawful deduction of wages. The claims were in respect of bank-holidays and overtime, and Mr Hamilton was awarded £2,519.37. A number of further claims by him were dismissed.
Although the sum of money at stake was relatively small, LTRS appealed to the EAT - and won.
