Luke v Stoke on Trent City Council - right of employer to require non-contractual duties - EAT 13.10.06

Mrs Luke is a special needs teacher who was employed by Stoke Council. Trouble arose between her and the Head Teacher of the ACE centre, one of the two units at which she was contracted to work. The ACE centre is a unit for children with severe behavioural problems and is the only such unit run by the Council. Mrs Luke refused to consider suggestions of alternative work. Eventually the Council stopped her wages. The main question in her subsequent claim for unlawful deduction of wages was whether the Council was entitled to require her to work elsewhere than at the ACE Centre.
