M-Choice UK Ltd v Aalders - summary dismissal during notice period brings forward Effective Date of Termination

When an employer summarily dismisses an employee who is already in their notice period, this has the effect of bringing forward the Effective Date of Termination (EDT) from that originally envisaged by the notice to the date of the summary dismissal. A "bad" reason for the summary dismissal (such as seeking to deprive the employee of sufficient qualifying service to bring a claim) makes no difference to its effect - although it may in itself, of course, trigger further claims.
