Ma v Merck Sharpe & Dohme Ltd - Original decision on time limits and whether incidents formed part of continuing act was not perverse [2008] EAT

At a pre-hearing review an Employment Judge carefully considered numerous allegations of race discrimination made by Dr Ma extending back to 1997. On the basis that some could reasonably be argued to have formed part of an alleged continuing act she set ordered that these could proceed to a full hearing. The other allegations were dismissed as being out of time and so beyond the tribunal's jurisdiction.
