Mackenzie v Billing Aquadrome Ltd - ET's duty to determine matters remitted to it by EAT, whatever its own views on that may be
When the EAT remits a matter for rehearing by an employment tribunal, and sets out in its order what issues the tribunal must determine, then those are the issues that the tribunal has a duty to decide upon. Whether the tribunal agrees with the EAT's approach or its reasons is neither here nor there - and it does not engender confidence in the process if it makes its views loudly and clearly known.
