Mackenzie v Billing Aquadrome - Tribunal must establish circumstances of termination of employment contract [2008] EAT

Mr MacKenzie objected when Billing attempted to alter the basis of his bonus award in his contract. There were discussions where Mr MacKenzie made clear that he considered the changes a fundamental breach, but despite his managers suggesting that he was resigning this was not made clear. In any event he did not work after 4 February 2007.

An employment tribunal concluded that he had been fairly dismissed. However its decision comprised 8 paragraphs over 2 pages - despite there having been a 5 day hearing.
