Mahon v Accuread Ltd - Medical report by jointly agreed expert cannot be "demolished or discredited" without the opportunity to have the expert cross-examined at the hearing [2008] EAT

Meter reader Mr Mahon claimed disability discrimination by way of failure to make reasonable adjustments. An employment tribunal held a preliminary hearing on the question of whether he was disabled within the meaning of Disability Discrimination Act 1995. A medical expert had been jointly instructed, and his detailed report was largely favourable to Mr Mahon - whom he concluded was not capable of doing his job without extensive adjustments to it.
