Makar v Triad Group Plc. - expert evidence at tribunals - EAT 18.10.06
Miss Makar was chief executive of Triad Group plc, a stock exchange listed IT company. She was dismissed and removed as a director in December 2005 after raising concerns about financial impropriety, which she claims are "qualifying disclosures" under the whistleblowing rules. As a result she is claiming "automatic" unfair dismissal under ERA 1996 s.103(A). At case management stage a tribunal chairman ordered that "... expert evidence ... is not required where [the employer] has conceded both a qualifying disclosure and reasonable belief...".
