Makro Self Service Wholesalers Ltd v Rees - burden of proof in deciding reasonableness of dismissal is neutral - 20.6.08

Mr Rees was dismissed for misconduct. An employment tribunal held that Makro genuinely believed that Mr Rees was guilty of sexual harassment of a colleague but "had failed to establish that there were reasonable grounds for that belief". It therefore found the dismissal unfair. Mr Rees appealed.
