Mr Rees was dismissed for misconduct. An employment tribunal held that Makro genuinely believed that Mr Rees was guilty of sexual harassment of a colleague but "had failed to establish that there were reasonable grounds for that belief". It therefore found the dismissal unfair. Mr Rees appealed.
