Marks and Spencer plc v Powell - EAT's decision substituted for that of a Tribunal that has seriously erred in law [2011] EAT

The Employment Appeal Tribunal may substitute its own decision for that of a Tribunal that has made serious errors of law in deciding a case: nothing is to be gained by ordering that the case be re-heard by a Tribunal.
