Marriott Motor Group & Others v Cottington - serving a statement for a witness does not compel a party to call that witness

Business manager Ms Cottington was dismissed, following a meeting where her performance was criticised. No procedures were followed - Marriott felt these unnecessary as she had been employed less than one year. However she claimed sex discrimination and alleged various acts of domineering behaviour and bullying. An employment tribunal found in her favour. Marriott appealed.

The EAT studied the tribunal's reasoning carefully.
