Under the Working Time Regulations 1998 reg 16 a week's holiday pay must be calculated in the same way as a 'week's pay' under Employment Rights Act 1996. Therefore if remuneration varies "with the amount of work done..." it must be averaged over 12 weeks. Problems arise if remuneration (eg bonus or commission) varies according to results - does this count as varying "with the amount of work done"?
