Leave to appeal refused. 


Mr McAlpine was made redundant in June 2006. He believed he was selected for redundancy because he was a diabetic or for reasons relating to his diabetes and so presented a claim for unfair dismissal and discrimination under the Disability Discrimination Act 1995. This claim was dismissed by an employment tribunal.
