McCall v Northern Rail Ltd - Standard of proof in unfair dismissal cases where employer claims he "would have dismissed anyway"  EAT
Mr McCall, a ticket collector on a train, found two young girls who did not have enough money for their fare. He sold them tickets for a shorter journey but was caught out. The girls alleged that he had spoken to them in sexually inappropriate terms and had taken them into his cab. The girls later admitted this was untrue. Mr McCall was dismissed after a disciplinary hearing. He complained of unfair dismissal but lost at the Manchester employment tribunal.
