McKechnie Oliver v John R Weir Ltd - Costs/expenses in EAT [2006] EAT

Rule 34A of the EAT Rules gives the EAT discretion to order a party to pay costs (expenses in Scotland) if proceedings were "unnecessary, improper, vexatious or misconceived or that there has been unreasonable delay or other unreasonable conduct in the bringing or conducting of proceedings by the paying party". John Weir Ltd applied to the EAT in Edinburgh for an order that Mr McKechnie Oliver should pay £4,000 towards their expenses following an unsuccessful appeal he had brought to the EAT in January 2006.
