McKenzie v Teen Spirit Ltd - Amending a tribunal claim EAT
In March 2007 Mr McKenzie filed a tribunal claim against his employer alleging victimisation contrary to the Disability Discrimination Act 1995. Not long afterwards he was dismissed and in June filed another claim. Partly as a result of an error in confusing the first and second claims and partly as a result of the adjournment of a hearing and the relevance of the statutory grievance procedures, the employment judge misapplied time limits and refused to grant him permission to amend this second claim. He appealed to the EAT.
