Strike out order on review set aside and rehearing ordered following the Court of Appeal's rejection (in a different case) of the strict approach previously adopted by the EAT.
Ms Miller's had a tribunal claim struck out for want of prosecution. An employment judge allowed her application for review (in other words he did not hold that it had no reasonable prospect of success). Ms Miller failed to attend the review hearing and the strike out order was confirmed.
