Minakova v Brownlow Properties Ltd - The (very) late production of documents that should have been in Hearing Bundle  EAT
A tribunal is right to refuse to admit further evidence, in the form of documents which could and should have been included in a joint bundle and which in any event do not advance a party's case any further, when it is only produced after evidence has closed and submissions are underway.
Care Assistant Ms Minakova claimed unfair dismissal and unlawful deduction of wages. In preparation for the hearing, Brownlow's solicitors sent her a draft bundle which included some documents originally hers, such as pay-slips and contract, and invited her to add any further documents to that draft bundle to be incorporated in a joint bundle for the hearing. Ms Minakova did not do so.
