Mr Kemeh, a Ghanian and British citizen, worked as a chef for the British Army and was subjected to two incidents of racial abuse, the first comment made by Ms Ausher who worked for Sodexho, to whom catering had been sub-contracted by Serco at the Falklands Island garrison, where Mr Kemeh worked. The other comment was made by a senior officer, Sgt Simmons.
