The Mudchute Association v Petherbridge - Statutory Grievance Procedure 2004 Regulations [2005] EAT

EAT confirms that failure to deal with a grievance properly can be a breach of the implied term of Trust and Confidence, giving rise of itself to a claim of constructive unfair dismissal. The EAT also covers a technical point to the effect that the word ‘"action"’ in reg 2(1) of the Employment Act 2002 (Dispute Resolution) Regulations 2004 can include action by the employer on an earlier grievance raised by the employee.
