Mustafa v Guy's And St Thomas NHS Foundation Trust - Relief from strike-out [2011] EAT

When considering whether to grant relief for a strike-out, a judge must consider, and be clearly seen to consider, (i) whether the cardinal conditions for exercising the power of strike-out were met, and (ii) as a separate and further exercise, whether strike out was even so a proportionate response to the failings of the party in question.

Pharmacist Ms Mustafa suffered Chronic Fatigue Syndrome and was eventually dismissed on grounds of capability. She brought employment tribunal claims for disability discrimination and unfair dismissal. The Trust entered a full response to both claims, but sought Further & Better Particulars (F&BPs) before it could properly respond to the dismissal claim. At a Case Management Discussion (CMD), in the light of the position the Trust took on the disability claim, Ms Mustafa was ordered to provide F&BPs of that claim. After a number of failures to provide such information, the tribunal made an "Unless Order".
