N Todd t/a Hygia Professional Training v R Cutter - No "second bite of the cherry" on appeal [2007] EAT

Mr Cutter was awarded compensation having been unfairly dismissed by Mr Todd. At neither the employment tribunal hearing nor the subsequent remedies hearing, did Mr Todd present evidence that Mr Cutter had intended to leave his employment anyway. Such evidence would have meant Mr Cutter receiving no compensation at all. Mr Todd appealed against the compensation award and attempted to put such evidence before the EAT.
