National Centre for Young People With Epilepsy v Boateng - waiver of legal privilege

Subject to general considerations of fairness it is likely that a party will be held to have waived legal privilege if their claim is based on the content of confidential communications with their legal advisor.

Mrs Boateng worked as a night support worker for the National Centre for Young People with Epilepsy from June 2006 until 8th July 2010. Her employment was terminated under the terms of a Compromise Agreement which settled claims she had brought in the Employment Tribunal (the claims were of unlawful race and age discrimination).
