Newquest (Herald & Times) Ltd v Keeping - Extension of time limits [2010] EAT

In considering an application to amend an equal pay claim which would be time-barred were it to have been brought as an independent claim, the Tribunal must have consider the merit of the application and reasons given for the lateness in bringing the claim before using its discretion to allow the amendment.

Ms Keeping worked for Newsquest (Herald and Times) Ltd as a Deputy Multi Media Editor from 1 September 2008 until 27 February 2009. She presented a complaint to the Employment Tribunal on 4 February 2009, setting out the fact that she had been underpaid for her role. One of the other Deputy Multi Media Editors, a man, was paid more than her. She named him as her comparator and sought equal pay under the Equal Pay Act 1970.
