Key Points

  • A contract of employment for an indefinite period (as opposed to a fixed term contract) may be terminated by either party giving notice to the other.
  • The length of notice to be given will be determined by any express agreement in the employment contract, and in absence of that by what the court implies is reasonable notice in the circumstances, both being subject to the minimum notice requirements set out by statute.
