NSM Music Ltd. v Leefe [2006] EAT
Mr Leefe was dismissed from his job as technical sales manager for NSM Music in January 2005. NSM claimed the reason was redundancy. There had been no consultation and Mr Leefe claimed unfair dismissal. NSM missed the deadline for submitting a response to this claim and was thus debarred from taking any part in the proceedings. A tribunal found the dismissal was by reason of redundancy but was "unfair both procedurally and substantively". It awarded compensatory award of £48,962 (no basic award was ordered as this was discharged by the statutory redundancy payment already made).
