Nunn v Royal Mail Group Ltd - No shift in burden of proof when deciding between competing reasons for dismissal [2010] EAT

When a tribunal has to decide between competing reasons for dismissal, it must simply decide if what the employer puts forward was, indeed, the reason. There is no question of applying the "shifting burden of proof" approach from discrimination cases as a means of testing the reason for dismissal suggested by the employee.
