Nuttall v Szewczuk & Anor - Erroneous reading of contract led to excessive award for wrongful dismissal  EAT
Compensation for wrongful dismissal must be calculated accurately on the basis of the terms of the employment contract.
Mr Szewczuk was dismissed on 25 October 2010 after just a few weeks in his job. He claimed non payment of wages, non payment of money in lieu of notice and unpaid holiday money from his former employer, Mr Nuttall. He succeeded in his claim at employment tribunal, where he was awarded £1000 payment in lieu of notice in accordance with a term of his contract of employment - in other words, 4 weeks notice at £250 per week.
