Octopus Jewellery Ltd v Stephenson - ambiguity as to date of termination of employment  EAT
Ms Stephenson claimed unfair dismissal and that £500 had been wrongly deducted from her earnings by Octopus.
A tribunal found that her claim was made two days out of time but allowed it to proceed anyway. This was on the basis that it had not been reasonably practicable for her to have presented her claim in time because she, and the CAB which advised her, had understandably misunderstood the effective date of termination as a result of ambiguous language used by the employer.
The EAT has dismissed Octopus's appeal.
