Okinedo v (1) Northwest Guarding Ltd (Debarred) (2) Bynoe - case management decisions can normally only be revisited when circumstances significantly change - EAT 8.4.08

Mr Okinedo brought employment tribunal claims against Northwest Guarding Ltd. At the heart of his complaints was Neil Bynoe, sole owner and director. When Mr Okinedo learnt that Northwest was on the verge of insolvency, he applied to amend his claim to include Mr Bynoe as a second Respondent. The tribunal refused. When Northwest then became insolvent, Mr Okinedo again sought to amend to add Mr Bynoe as a Respondent. The Tribunal refused on the grounds that the application had already been made and refused. Mr Okinedo appealed.
