Old Buckenham Park (Brettenham) Educational Trust Ltd v Parker - Part time disabled teacher wins claims on being replaced by a full time teacher  EAT
EAT confirms findings of constructive unfair dismissal and discrimination against a disabled part-time teacher when the employing school advertised for a full time replacement.
Ms Parker was employed as Art Teacher at Old Buckenham Hall, a well known private junior school, from 1995 until her resignation in 2007. She worked part time but the job got bigger over the years. Ms Parker suffered from a disability and became unable to cope with the additional load. Some additional help (an assistant teacher) was provided for her but this was costly and the school decided that the job could best be done by someone working full time. Ms Parker applied for the post but was not successful. She resigned.
