O'Neil v Wooldridge Ecotech Ltd - Requirements of modified statutory dismissal procedure [2007] EAT

Ecotech dismissed Mr O'Neil, one of their drivers, after a number of problems with his performance culminating in a telephone conversation where he swore at his foreman. The dismissal came the day after that conversation, without any warning or disciplinary meeting. Mr O'Neil was given a letter confirming his dismissal and his right to appeal. An employment tribunal held that the dismissal was fair. Mr O'Neil appealed.
