Opal Telecom Ltd v Rowe - No perversity in tribunal ruling  EAT
The Bristol employment tribunal fund that Miss Rowe had been constructively dismissed. She had resigned following a series of events including unfair and delayed disciplinary procedures culminating in a "last straw". The employers' appeal was put on the basis of perversity but the EAT has held that the findings which the tribunal had reached were all open to them and that there was no perversity. The EAT dismissed the employer's appeal.
