Orchid Pubs Ltd v Griffiths - Tribunal must consider whole period of delay when deciding whether to extend time [2008] EAT
Mr Griffiths was dismissed for gross misconduct on 29 June 2007. Believing this to be race discrimination he took advice from the Commission for Racial Equality. The CRE told him that he had 6 months in which to present any claim to an employment tribunal, but on 26 October the CRE advised him of its mistake, and urged him to act quickly. Mr Griffiths presented his claim on 21 December 2007 - nearly three months after the statutory three month time limit expired.
