Pan v Portigon AG London Branch - No discriminatory conduct despite evidence of tortuous conduct [2013] EAT

ET can find that allegations of tortious conduct were made out but that there was no discriminatory conduct

This is an appeal by Mr Pan against an ET decision dismissing his complaints of unlawful racial discrimination, harassment, victimisation and constructive unfair dismissal. Mr Pan, who is of Chinese nationality and ethnic origin,worked for Portigon bank as a leverage loan credit analyst. He resigned from his employment on 6 December 2010. During his employment he presented his first form ET1 complaining of racial discrimination, victimisation and harassment. Following his resignation he presented a second form ET1 complaining of further acts of discrimination and contending that he resigned in circumstances amounting to constructive unfair dismissal.
