Parsons v Bristol Street Fourth Investments Ltd (t/a Bristol Street Motors) - Likely effect of behaviour, objectively viewed, essential element in constructive unfair dismissal [2008] EAT
Car salesman Mr Parsons suffered unacceptable behaviour from his manager Mr Lawrence (for want of a better way to describe hitting people in the testicles and calling them "old parsonage/buzzard/git"). Perhaps not surprisingly, he resigned and claimed constructive dismissal. An employment tribunal accepted the sincerity of his hurt feelings. However it also concluded that Mr Lawrence's behaviour (which was similar towards all his staff) was not calculated to end the employment relationship, nor did Mr Lawrence wish to bring it to an end. Mr Parsons appealed.
