Parsons v Burworth Estates - no requirement that all breaches must have been covered by grievance before constructive dismissal claim can proceed [2009] EAT

If a claim of constructive unfair dismissal is made which is subject to the 2004 statutory grievance requirements, and a number of separate, discrete, breaches are relied on but some of those breaches have not been the subject of grievances, there is in principle no reason why the other claims cannot be pursued on a "severed basis".   The EAT decision in Cyprus Airways Ltd. v Lambrou on 1st May 2007 was wrong if and in so far as it suggested the contrary.
