Part Time Workers Holidays

Key Points

  • There are no special provisions in the Working Time Regulations 1998 for part time workers. They are entitled to the same paid holiday rights (pro-rata'd) as full-timer workers.
  • The holiday pay entitlement of shift workers presents a particular problem if they are entitled to different amounts depending on which shift they worked (eg night or day, weekend or weekday).
  • In May 2006 the Court of Appeal ruled that it is lawful for holiday pay to be assessed by reference to the same arrangements applied for calculating normal pay for smoothing out fluctuations in the pay due to such workers (British Airways PLC v Noble & Forde CA 2006 IRLR 533).
