Peregrine (Deceased) v amazon.co.uk Ltd - Reasonable Adjustments and Recurring Disability [2013] EAT

An employer did not err in failing to link apparently unrelated symptoms to an earlier diagnosis of cancer when the employee himself did not make that link.

The case was bought on behalf of Mr Peregrine (deceased) by his mother, Mrs Peregrine Davies. His employer at the time of his death was Amazon and they had actual, or constructive knowledge through their agent, that Mr Peregrine had suffered with cancer prior to his employment. Unfortunately the secondary cancer that led to his death was not diagnosed early because Mr Peregrine did not realise that his back pain symptoms were related to his earlier illness. As a consequence he died on the 3rd February 2011 aged 36.
