Pervez v Macquarie Bank Ltd (London Branch) & Anor - foreign employee of overseas company seconded to a UK company can bring claims
For purposes of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004 reg 19(1) (jurisdiction of tribunals in Scotland and in England and Wales) an overseas company can 'carry on business' in England and Wales by seconding an employee to work at an establishment here. It follows that employees of foreign-registered multinational companies posted to offices in England can sue their employers under British employment law.
