Persistent and deliberate refusal to comply with a reasonable management instruction, after warnings were give, amounted to gross misconduct justifying summary dismissal - regardless of how sincerely the principle behind that refusal may have been held.
Petrofac Offshore Management (POM) provides skilled crew for oil-rigs. Mr Wilson worked on Maersk's Gryphon Alpha platform in the North Sea. To meet HSE requirements Maersk required all its contractors to put in place a a Competent Person Profile (CPP) process (involving completing paperwork to show competence in various areas), and POM introduced participation in CPP as a contractual requirement for all its employees.
