An employment tribunal should strike out a whistle-blowing or discrimination claim at a preliminary stage only in exceptional circumstances. Strike out involves a conclusion that disputed facts would almost certainly be resolved against the claimant: only in the most extreme and obvious cases could such an assessment be made without fully hearing all the evidence.
