If a tribunal decides to take account of a party's ability to pay when making a costs order, it is unfair of it to criticise that party for failing to provide detailed particulars of its finances without giving it a realistic period of time to do so.
Mrs Pinnock brought numerous claims before the Employment Tribunal, and in the lead up to the hearing various issues arose concerning orders and directions towards preparation.
