Piper v Maidstone & Tunbridge Wells NHS Trust - dismissal was not expunged by lesser penalty after appeal
If an employee is dismissed, the fact that an internal appeal process subsequently imposes a lesser penalty cannot, of itself, expunge the original dismissal so as to bar an unfair dismissal claim.
Reverend Stuart Piper, was employed by the Trust as a Lead Chaplain at Maidstone Hospital, his pay band was 7. He was dismissed for gross misconduct on 20 July 2011. He appealed his dismissal.
