Premier Foods Plc v Garner - Dismissal procedures  EAT
Several employees were suspected of spiking the drink of another employee. Disciplinary proceedings were started against all those "accused". All were given written warnings. It became apparent that one of them, Mrs Garner, was the most likely perpetrator. Following further disciplinary proceedings she was dismissed. An employment tribunal at Bury St Edmunds held that her dismissal was both "ordinarily" unfair and also "automatically" unfair as the statutory dismissal procedures had not been properly followed in respect of the further disciplinary proceedings.
