Premium Care Homes Ltd v Osborne - Striking out [2006] EAT
An employment tribunal in Truro (Cornwall) debarred a nursing home company from defending an unfair dismissal (whistleblowing) claim by a former manager.
The main reason for strtiking out was that the employer had failed to comply with various preliminary orders, compunded by the fact that it attended the hearing with new documents. However the tribunal allowed the employer to argue on quantum - that the claim was excessive (it was for £100,000). In the event the tribunal awarded Ms Osborne £12,280.
The employer's appeal to the EAT has been dismissed.
