Prison Officers’ Association v Darken - Fair election of union officials [2007] EAT

There were 3 candidates for election as Vice-Chair of the Prison Officers’ Association, an independent trade union recognised for the purpose of collective bargaining for prison officers throughout the UK. All of them got their election addresses in by the deadline set, but one of them, Mr Darken, only had one day to prepare his address because of an inadvertent failure by the Union to inform him of the deadline. The other 2 candidates had had 28 days to prepare their addresses and they both came ahead of Mr Darken when the results were announced.
